Terms of Service

1. The service

ReefOffice provides managed, self-hosted server instances ("Servers") in the European Union. Each Server runs a pre-configured stack of open-source software including Nextcloud, Authentik, Vaultwarden, Dolibarr, Activepieces, and other services.

You ("the Client") retain full ownership of all data stored on your Server. ReefOffice does not access, read, or process your data except as necessary to provide the service (maintenance, updates, support).

Professional use. ReefOffice is offered to professionals — companies and self-employed people (freelancers, auto-entrepreneurs, consultants, agencies) subscribing for their business activity. It is not marketed to or intended for consumers; by subscribing, you confirm you are acting for purposes within your trade, business, or profession.

2. Subscription & payment

Subscriptions are paid via Mollie. ReefOffice is currently operated by a French micro-entrepreneur under the VAT franchise (franchise en base de TVA): French VAT is not charged — TVA non applicable, art. 293 B du CGI. The checkout and invoice state the total amount payable. Tax treatment can depend on the customer's country and business status; contact us before purchase if you need a specific cross-border invoice treatment.

Payment is due at the beginning of each billing period. Failed payments result in account suspension after a 7-day grace period.

The founding price is an amount **excluding tax**, locked for the life of your subscription. What is guaranteed is the price before tax; applicable taxes are added where due. ReefOffice currently falls under the French franchise en base, so no French VAT is charged and the pre-tax amount is therefore the amount paid. If ReefOffice ceases to fall under that regime, the founding price before tax is unchanged and applicable VAT is added.

3. Cancellation & refunds

You may cancel your subscription at any time from the ReefOffice Billing page. Upon cancellation:

• Your Server remains active until the end of the current billing period
• After the billing period ends, your Server is securely wiped within 7 days
• Backups are retained for 30 days, then permanently deleted

We offer a 30-day money-back guarantee. If you request a refund within 30 days of your first payment, we refund that payment in full. After 30 days, no refunds are provided unless required by law.

4. Acceptable use

You agree not to use your Server for:

• Illegal activities under EU or French law
• Sending spam or unsolicited bulk email
• Hosting malware, phishing sites, or content that facilitates fraud
• Cryptocurrency mining
• Any activity that degrades Contabo's shared infrastructure

Violation of these terms may result in immediate account suspension.

4b. AI features

Some plans include AI features. The underlying models are provided by third parties. By using an AI feature you accept those model licences and the code of conduct of the inference host, which we make available to you before first use.

You agree not to use AI features for:

• Facial recognition, creditworthiness assessment, or social scoring
• Medical, legal, financial, military or transport decisions without appropriate human supervision
• Screening job applicants, evaluating or monitoring employees, allocating work, assessing learners, or determining access to essential services — uses covered by Annex III of Regulation (EU) 2024/1689
• Generating misleading content presented as human-authored, or content that infringes third-party rights

AI output is informational, may be inaccurate, and does not replace advice from a qualified professional. You must check any output before relying on it, publishing it, or basing a decision on it.

You indemnify ReefOffice against any claim arising from use of AI features contrary to this section.

5. Service level

We strive to maintain 99.5% uptime for managed Servers. In the event of downtime caused by Contabo infrastructure failures, we will communicate the issue and expected resolution time.

ReefOffice is not liable for data loss. We recommend clients maintain their own additional backups of critical data. Our included backup service (Restic, AES-256 encrypted) is a convenience, not a guarantee.

6. Limitation of liability

ReefOffice's liability is limited to the amount paid by the Client in the 12 months preceding the claim. We are not liable for indirect damages, loss of revenue, or data loss resulting from the use of our service.

7. Governing law & disputes

These terms are governed by French law. The courts of Nanterre (France) have exclusive jurisdiction over any dispute relating to these terms or the service.

8. Changes to these terms

We will notify you by email of any material changes to these terms at least 30 days before they take effect. Continued use of the service after changes take effect constitutes acceptance.
